Karnataka HC to hear CCI plea against Amazon, Flipkart on Jan 18

On October 26, the Supreme Court had asked the Karnataka HC to decide on the CCI plea within six weeks.

The Karnataka High Court on Wednesday posted the final date for hearing the Competition Commission of India's (CCI) plea to vacate the stay on an investigation into e-commerce giants Flipkart and Amazon for engaging in potentially anticompetitive activities to January 18, 2021.

The single judge bench heard the case on Wednesday after the Supreme Court on October 26 asked the Karnataka HC to decide on the CCI plea within six weeks, as the apex court bench headed by Justice AM Khanwikar refused to admit the competition watchdog's plea.

The CCI had approached the SC on October 7 to appeal against the Karnataka HC’s stay on an investigation into the two e-commerce companies. The CCI had said that it approached the apex court as there had been a delay of over 200 days in hearing the case.

Amazon and Flipkart had in February filed petitions against the CCI’s order to investigate them on grounds of engaging in potentially anticompetitive activities based on information filed by trader group Delhi Vyapar Mahasangh (DVM) and the Confederation of All India Traders (CAIT).

The Karnataka HC on February 14 had granted an interim stay on the CCI’s investigation, and had granted all parties involved in the case a two month period to respond.
