Big win for Kejriwal govt, SC says L-G is bound by aid and advice of Cabinet

In a major victory for Delhi government, a 5-judge bench of SC ruled that the LG cannot act as an obstructionist to policy decisions taken by Cabinet. In the judgment given by CJI Dipak Misra, Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan said LG is bound by the aid and advice of council of ministers of Delhi government. Delhi enjoys a unique position under Constitution and neither L-G nor the CM heading the council of ministers should consider themselves bigger than the other. They must work harmoniously, SC said.
