Bombay High Court rejects Meta’s plea challenging jurisdiction in Blink Digital dispute; interim relief hearing on November 2.
The matter was heard by Justice Sandeep V. Marne. Meta had argued that the dispute should be heard by courts in California, relying on its contractual jurisdiction provisions. Blink Digital opposed the challenge, seeking to pursue its claims in India.
The dispute arose after Blink Digital’s Business Manager accounts and associated corporate pages were disabled. The company has sought restoration of the accounts and pages, along with Rs 1,158 crore in damages and compensation, from Meta Platforms, Inc. and Facebook India Online Services Pvt. Ltd.
The jurisdictional dispute centres on whether the Bombay High Court can hear the case despite Meta’s reliance on overseas contractual provisions. The court’s dismissal of Meta’s application allows the proceedings to continue, while the underlying claims remain to be adjudicated.
Kunal Dwarakadas and Siddharth Joshi, instructed by a team led by Naval Sharma of Tuli & Co., appeared for Blink Digital. Senior Advocate Janak Dwarkadas, instructed by Shardul Amarchand Mangaldas, represented Meta.
The written order setting out the court’s reasons was awaited at the time of reporting. The court is scheduled to hear Blink Digital’s interim-relief application on November 2 at 4 pm.
