'Chhapaak' row: Delhi HC upholds trial court orders, restrains screening from Jan 15 if credit not restored

The court directed the film's makers to give credit to lawyer Aparna Bhat.

NEW DELHI: The Delhi High Court, on Saturday, passed an order restraining the release of 'Chhapaak' without giving due credit to acid attack survivor Lakshmi Agarwal's lawyer, Aparna Bhat.

Justice Pratibha M. Singh ruled that the restraint will be effective from January 15 for multiplexes and live streaming apps, and from January 17 for all other platforms.

News agency ANI confirmed the news in a tweet, "Delhi High Court restrains from releasing of film 'Chhapaak' without giving credit to lawyer Aparna Bhat, who represented survivor Lakshmi in her legal battle. The restraint will be effective from January 15 for multiplexes and live streaming and for others from January 17."



Fox Star Studios had approached the High Court challenging the order of the trial court that directed them to give credits to Bhat in the film.

On Friday, the Delhi High Court had reserved order on Fox Star Studio's plea.

The makers during the hearing on Friday told the High Court that Bhat had no legal right, statutory or contractual, to seek acknowledgement for her contribution in the film in the form of consultation, inputs and documents.

Opposing the claims made by the counsel for the film-makers, senior advocate Sanjay Parikh, on behalf of Bhat, said that the conduct of the film-makers amounted to breach of trust and her claim seeking acknowledgement in the film was not only based on promissory estoppel but "something higher".

Parikh went on to add that Bhat offered her assistance to the making of the film pro bono, pursuant to which substantial changes were made to the film.

Earlier on Thursday, Delhi's Patiala House court had directed the makers of 'Chhapaak' to give due credits to Bhat. The court had passed an order that the makers of the film include the line "Aparna Bhat continues to fight cases of sexual and physical violence against women" during the screening of it.

Lawyer Aparna Bhat fought the criminal case for Lakshmi Agarwal, on whose life the film that released on Friday, is based.
