Noida teen gets relief as complainant withdraws case over PM Modi remarks

The complainant in the case against a 15-year-old girl accused of making abusive remarks against Prime Minister Narendra Modi during a Cockroach Janta Party (CJP)-led protest has withdrawn her complaint, saying she no longer wishes to pursue the matter after the teenager apologised and the prime minister forgave her.

Supreme Court lawyer Smriti Singh, who filed the complaint, said she has informed the Delhi Police and Crime Branch of her decision to withdraw complaints against all eight girls named in the cases.

Complainant cites apology, PM's forgiveness

Speaking to PTI on Tuesday, Singh said she had initially lodged a complaint against eight girls, with the Noida teenager being the first among them.

According to Singh, a zero FIR was registered on July 29 at Noida's Expressway police station under Sections 352 (insult with intent to provoke breach of the peace), 353(1) (statements conducing to public mischief) and 356(1) (defamation) of the Bharatiya Nyaya Sanhita (BNS).

She said she had publicly stated she would withdraw the complaints if the girls apologised.

"After the prime minister appealed for forgiveness, the girls, including the Noida girl, uploaded apology videos. I had also posted a video saying that if the girls apologised, I would withdraw my complaint," Singh said.

She added that after all eight girls apologised, she decided to withdraw every complaint.

"Since the prime minister forgave them, I also do not want to pursue the matter further. I have communicated my decision to Delhi Police and Crime Branch," she said.

Family not at home, police deny harassment complaint

PTI reported that security guards and maintenance staff at the housing society in Noida's Sector 168, where the teenager and her mother lived, said the family was not at home.

They said personnel from Delhi and Noida Police had visited the residence after the video surfaced but were unaware of the family's current whereabouts.

Responding to the family's allegations of harassment, an official at Noida's Expressway police station said no complaint had been received regarding any harassment within its jurisdiction.

The official said Noida Police registered a zero FIR and transferred it to Delhi Police because the alleged incident occurred in the national capital.

The officer added that the family had not contacted local police since then and suggested they may have temporarily shifted to Faridabad.

Mother sought withdrawal of case

Earlier, the teenager's mother had appealed to Prime Minister Modi to forgive her daughter, saying the family had repeatedly apologised and that the minor had been influenced during the protest.

Speaking to PTI Videos on August 1, she thanked the prime minister for publicly forgiving her daughter and urged him to consider restricting access to social media platforms such as Instagram and Facebook for children aged 10 to 20.

She also requested that minors be kept away from protests and political activities, arguing that they could be easily influenced.

The mother claimed police personnel repeatedly visited their residence after the video went viral and appealed for the case to be withdrawn, saying her daughter was 15 years old and should be allowed to "live peacefully."

Lawyer questions FIR, Delhi Police yet to register regular case

The family's lawyer, Anil Kumar, said the teenager was a juvenile and alleged that the complaint incorrectly identified her as a 25-year-old salon employee.

He claimed the FIR had been registered without proper preliminary verification.

The controversy began after a video purportedly showing the girl using abusive language against the prime minister during a CJP-led protest at Delhi's Jantar Mantar circulated on social media. The protest was held against paper leaks and alleged irregularities in the education system, while demanding the resignation of former Union Education Minister Dharmendra Pradhan, who later stepped down.

The teenager subsequently posted an apology video, saying she had been influenced, was "extremely embarrassed and ashamed," and described the incident as her "first and last mistake."

Prime Minister Modi later said he had forgiven the students who allegedly abused him and his late mother, adding that they should be guided rather than punished.

Police sources had earlier said the zero FIR remained under examination and had not been converted into a regular FIR. They also clarified that no separate FIR had been registered in Delhi in the case so far.
