The lawsuit comes at a time when mid-term elections will be held on November 3rd. The two defendants have denied all allegations of wrongdoing through their legal representatives, who have raised questions regarding the evidence and timing of the lawsuit.
As reported by the Associated Press, the charges revolve around a debate which has been ongoing between the lawmakers and intelligence officials for many years after the laptop was revealed to the public.
Why the DOJ is accusing two former FBI officials of misleading Congress
Criminal charges revolve around information provided by Floris and Benavides to the House Judiciary Committee regarding the involvement of the FBI in cases concerning Hunter Biden.Floris, who had worked in the position of deputy assistant director of the Foreign Influence Task Force, reportedly told congressional investigators that she was not involved in discussions regarding Hunter Biden when she held this position in July 2023. Benavides, who had worked as the section chief of the Foreign Influence Task Force, is reported to have informed the committee that he came to know about the existence of the laptop on Wikipedia.
The government alleges that communications, documents, and testimonies contradict these claims. Based on the complaint filed by the US Department of Justice, both officials were aware of discussions about the investigations and the laptop prior to the 2020 election.
Both officials are charged with one count of making false statements regarding matters under the jurisdiction of the legislative body. This case was filed via criminal complaint and not through a grand jury indictment.
This makes a difference because the claims have yet to be proved in the court of law. There is an assumption that both officials are innocent until proven guilty.
The laptop controversy that shook the 2020 presidential election
History of the case began in October 2020 when the New York Post released an article that was based on the materials from a laptop which had belonged to Hunter Biden and was found at a computer repair shop in Wilmington, Delaware. It contained emails about his business activities outside America, causing the Republicans to ask questions regarding whether the FBI had made enough disclosures about the matter. There were suspicions that the discovery of the laptop could somehow be connected with the involvement of other nations. Some Democrats and former members of the intelligence community suspected that the information from the laptop could somehow be associated with a Russian influence operation.
Several former US intelligence officers also signed a letter stating that the situation looked like one that could be considered a likely Russian information operation. But according to then-Director of National Intelligence John Ratcliffe, there was no proof at all of foreign influence on the laptop. The FBI, led by Director Christopher Wray, also supported that conclusion.
But this case became one more area of constant disputes between Republicans and Democrats, where Republicans in Congress accused the bureau of lacking transparency concerning the materials.
The fact is that Hunter Biden was found guilty of federal gun offences and pleaded guilty of federal tax offences while his father was president. Joe Biden pardoned his son in the last days of his presidential term.
This time the prosecution of the FBI officials is related to their statements in Congress only, and not about the broader political discussion regarding the laptop.
As The Washington Post reported, the case has raised doubts about the bureau's actions in that regard.
Defence challenges timing as judge orders an early hearing
However, the indictments have faced a strong reaction from the lawyers representing the defendants, who claim that the charges are politically motivated and based on contested allegations.Floris' defence counsel called her an exemplary ex-intelligence official, denying the allegation of having lied to Congress. Her lawyers also raised the issue of the delay in the filing of the indictment after such a long time since the time of testimony by Floris, especially ahead of the midterm elections.
Similarly, Benavides’ defence counsel dismissed the accusations as frivolous and declared that their client would challenge the charges in court.
This has raised questions about the timing of the charges, considering that it has been the practice of federal prosecutors not to pursue any investigative action that may impact elections. The case has been filed just over a fortnight before the November 3 midterms.
In the hearing on Friday, US Magistrate Judge Zia Faruqui raised doubts about the unusual practice of using a criminal complaint based on allegations going back several years. He denied prosecutors’ request for more time and set the date of the preliminary hearing to the following Tuesday, October 27, as reported by the Associated Press.
The director of the FBI, Kash Patel, defended the prosecution and explained that those who misled Congress must be punished. The Foreign Influence Task Force, previously run by Floris and Benavides, was dismantled in February 2025.
Future hearings in court will reveal whether prosecutors can prove their allegations. At the moment, the case brings back a major issue of the 2020 election but, this time, the actions of the investigators are called into question.
