HC asks SAP India to restore services to Nayara Energy

New Delhi: The Delhi High Court on Monday directed software service provider SAP India to restore full and uninterrupted software services to Indo-Russian oil refining and marketing company Nayara Energy.

Justice Vikas Mahajan, while allowing Nayara Energy's plea seeking restoration of SAP India's suspended services, refused to keep the judgement in abeyance for two weeks, as sought by the software service provider.

Nayara Energy moved the court in September 2025 after SAP India had suspended all critical software support services due to imposition of EU sanctions against India's leading refinery player. Germany-based SAP stopped providing services to Nayara Energy after the European Union on July 18 last year imposed a new set of sanctions targeting Russian interests, as part of the efforts to exert economic pressure on Russia over the war with Ukraine. Nayara Energy had claimed that SAP's services were critical for it to issue invoices and that suspension of the software services by the latter was unnecessary. It also sought a direction to SAP India to provide all necessary SAP hardware keys for new hardware installation, as well as software change registration keys for customisation or migration of the SAP software installed by the former according to the agreements between them.

In addition, Nayara Energy had asked the court to restrain SAP India, including its partners, agents, assigns and all individuals acting on their behalf, from interfering in any manner with its right to access and continued use of the SAP software and services provided under the agreements. Nayara Energy was generating 8.5% of India's petroleum revenue and its work was critical to the energy security of the country, its counsel had claimed. However, SAP India had told the court that it could not provide the services on its own without support from the German parent and would be exposed to criminal sanctions in Germany.
