HC closes contempt case against SpiceJet chairman
New Delhi: The Delhi High Court on Tuesday closed contempt-of-court proceedings initiated against SpiceJet chairman Ajay Singh and the airline's directors for failing to fully comply with its order to hand over two Boeing aircraft and three engines to TWC Aviation Capital.

Noting that the main case against the airline was already disposed of, the court said there was no point in prolonging the contempt case when TWC Aviation Capital has the option to file an execution petition to take possession of the leased assets. Also, there are a lot of other cases pending before the court, it said.

A UK court had ordered SpiceJet to hand over the aircraft and engines to the leasing company for failing to pay dues of $14 million. TWC Aviation then moved the Delhi High Court seeking enforcement of the UK court's order.

On May 27, 2024, the HC ordered SpiceJet to hand over the aircraft and engines along with technical records by June 17 to the lessor.

On July 2, the HC issued a contempt notice to SpiceJet, its directors and other executives for failing to comply with its May order. It later ordered registration of a suo motu contempt case against the airline and its directors for non-compliance.

In its order closing the contempt case, the court noted SpiceJet's claim that the aircraft frame and engines were handed over to the leasing company along with certain technical records and parts of the aircraft. It also noted TWC Aviation's claim that the airline had yet to give complete technical records and that some aircraft parts were missing.
