But after Pike survived an attempted lethal injection on September 30, Gov. Bill Lee announced that Tennessee would halt the remaining executions scheduled for 2026 and ordered a comprehensive third-party review of the failed execution attempt.

According to the Tennessee Department of Correction, Pike received two doses of pentobarbital during the execution attempt but remained alive and was transported to an outside medical facility.
The attempt proceeded after the U.S. Supreme Court lifted a stay that had temporarily blocked Tennessee from carrying out the execution.

According to Tennessee court records, Sutton and his uncle, James Henderson Dellinger, were convicted of first-degree murder in Griffin's death. Both men were sentenced to death. The Tennessee Supreme Court later upheld their convictions and sentences.
In the case, Sutton and Dellinger were also convicted of first-degree murder. They received life sentences in that case, according to federal court records. Sutton has maintained his innocence.
Why has Sutton's case faced legal challenges?
One issue raised by Sutton's lawyers involves former Tennessee medical examiner Dr. Charles Harlan.Federal court records show that Sutton's attorneys sought records related to investigations into Harlan's professional conduct. In 2008, a federal court found that records concerning Harlan were relevant and discoverable in Sutton's case.
Sutton's lawyers have also challenged evidence concerning the estimated time of Griffin's death.
The 6th U.S. Circuit Court of Appeals later considered Sutton's claims involving alleged suppression of evidence and ineffective assistance of counsel. The court affirmed the rejection of those claims.
The Tennessee Supreme Court has also previously rejected Sutton's challenges to his conviction and death sentence.
Sutton's execution date
The Tennessee Supreme Court originally set Sutton's execution for October 6, 2022. Gov. Lee issued him a reprieve in May 2022. Tennessee then paused executions while the state worked on a revised lethal-injection protocol.In September 2025, the Tennessee Supreme Court reset Sutton's execution for December 3, 2026. But the situation changed after Pike's failed execution attempt.
