In 1999, a Texas family lost its mineral rights in a tax foreclosure; 20 years later, heirs challenged the sale, what did the state Supreme Court say?
In April 2024, the Supreme Court of Texas considered a dispute. It involved mineral interests that were sold at a tax auction in 1999. It was argued that the foreclosure should be declared invalid. It was because the people who owned the property ...

Gill v. Hill was a case centred around one key question. It was about can heirs challenge a tax foreclosure years after the law's deadline has passed if they believed the original owners were denied due process.
What exactly happened in this case?
Several local taxing authorities filed a lawsuit in 1998 against more than 250 property owners over unpaid taxes. The legal proceedings relied on notice. An affidavit stated that the owner's names and addresses were unknown and could not be found despite a diligent search. The property owners were represented by the same court-appointed attorney, who was appointed just eight days before the trial.
A court in February 1999 authorised the foreclosure of the properties. James W. Gill and Gale T. Goss owned mineral interests affected by the judgement.
David Hill purchased the foreclosed mineral interests the following month previously owned by Gill at an auction. In 1999, a sheriff's tax deed documented the transfer.
Why did the heirs challenge the sale 20 years later?
Gill's successors in interest in 2019 filed a lawsuit. They were seeking to have the 1999 foreclosure judgement declared void. They also wanted to establish their ownership of the mineral rights. The argument was that the original owners had not been properly served with notice of the foreclosure proceedings. The claim stated that the failure to provide the required notice meant the judgement and the subsequent tax sale were invalid.
Hill opposed the challenge.

What did the Texas Supreme Court decide?
It ruled in Hill's favour. The appeals court upheld that decision. The heirs then took the dispute to the state's highest court. The court said that Hill had established the statutory deadline defence, and noted that crucial legal developments after the earlier proceedings had changed how courts should assess such disputes.
