UP no more accepting Aadhaar as date of birth proof
An Aadhaar card will no longer be considered as a date of birth (DoB) proof, as per a circular issued by the Uttar Pradesh government.

The Maharashtra government has also said that certificates issued for delayed births and deaths on the basis of an Aadhaar card after August 11, 2023, should be withdrawn.

The Maha government also said that the delayed birth certificates issued on the basis of only Aadhaar card (without any proof of school certificate or date/place of birth) will also be reviewed.


What does the UP govt’s order say about Aadhaar as a proof of birth?

The Uttar Pradesh govt in its order referred to the letter number 16013/4/2020-RO-LKO/5416 dated 31.10.2025 from the Deputy Director, Unique Identification Authority of India (UIDAI), Regional Office, Lucknow. The UP government says that the order states that the Aadhaar card is not a valid proof of the date of birth.

“However, various state government departments continue to accept the Aadhaar card as proof of date of birth. In response, all state government departments are requested to inform the department of this matter. Therefore, you are requested to kindly instruct the concerned authorities not to accept Aadhar Card as proof of date of birth,” the UP govt statement said.

What does Maharashtra govt order say in its press statement about Aadhaar card?

The Maharashtra government said that many Tehsildar offices have issued delayed birth certificates to the applicants/beneficiaries on the basis of only Aadhaar card (without any proof of school certificate or date/place of birth).

The government instructed these officials that if any complaint is received or any error is found against such Aadhaar card, such orders will be reconsidered.

“The orders issued for issuing delayed birth certificates are erroneous and it is the responsibility of the Executive Magistrate/Tehsildar to reconsider such orders. The rules issued by the Public Health Department (SOP) or the Birth and Death Registration Act, 1969 have clearly stated that if any complaint is received or any error is found after the order for delayed birth registration is issued, the order should be reconsidered,” the Maharashtra government said.

The Maharashtra government, however, said that an Aadhaar card can be accepted as evidence for any subject/case.

In another important order, the Maharashtra government said that after the amendment made in the Birth and Death Registration Act, 1969 on August 11, 2023, the orders issued by the Naib Tehsildar should be withdrawn, and the withdrawn order should be verified at the level of the competent authority/District Collector.

The Maharashtra government said that some officials have issued birth certificates even though the Tehsildar has not ordered the delayed birth registration.

“Therefore, necessary action should be taken in coordination with all the concerned municipalities/municipalities to verify the said certificates,” reads the order.
