Buying a house, flat, or a plot involves several legal documents, but two of the most important are the Agreement of Sale and the Sale Deed. While both are part of a property transaction, they serve different purposes. An Agreement of Sale generally records the terms agreed between the buyer and seller, such as the property details, sale price, advance payment, balance payment, and the conditions that must be met before the final sale.
A Sale Deed, on the other hand, is the document through which the seller transfers ownership of the property to the buyer, subject to the applicable legal and registration requirements. This distinction is important because signing an Agreement of Sale or paying an advance does not, by itself, make the buyer the legal owner. In simple terms, the Agreement of Sale sets out the promise and terms of the transaction, while the Sale Deed completes the transfer of ownership.
