Court asks Rahejas to file their affidavit in Malad land case

The Rahejas had earlier claimed that Wadia's role as the estate agent had come to an end with the death of Bachoobai, the original owner of the land.

In the high profile case between industrialist Nusli Wadia and real-estate developer Gopal Raheja about challenging the administration rights over 460-acre land in Malad, a northern suburb of Mumbai, the court has asked Ferani Hotels to file their affidavit supporting its claims by August 22.

On Wednesday, the division bench comprising Justice D Y Chandrachud and Justice RD Dhanuka also asked Nusli Neville Wadia to submit his response by September 10. The final hearing will start on September 25.

The Rahejas had earlier claimed that Wadia’s role as the estate agent had come to an end with the death of Bachoobai, the original owner of the land.

In June the court ruled in favor of real estate developer Gopal Raheja allowing his company Ferani Hotels to continue developing and selling properties on over 460-acre land in Malad suburb of Mumbai. The court had also ordered Rahejas to continue depositing 12% revenue share arising out of such development in a separate bank account.

Senior Counsel Abhishek Manu Singhvi along with Vivek Vashi of Bharucha & Partners represented the Rahejas. While, Wadias were represented by Senior Counsel Fali Nariman and Navroz Seervai along with Doijode Associates.
