Absence of a Khata means that the property has not been formally recognised by the municipal authority for taxation purposes
Mrinal Trivedi, Associate Principal Partner, Square Yards says that the absence of a Khata does indicate that the property has not been formally recognised by the municipal authority for taxation purposes.Trivedi says: “This can lead to practical and administrative challenges. Homebuyers can apply for Khata registration or Khata transfer with BBMP by submitting the registered sale deed, occupancy certificate, approved building plan, tax paid receipts, and other prescribed documents.”
According to Trivedi, if there are deviations or approvals pending, regularisation or compliance may be required before Khata is issued.
Trivedi also says that a Khata is not a title document by itself, but it is an important municipal record that reflects the property’s entry in BBMP’s tax assessment register.
Trivedi says: “Legal ownership of a property is primarily established through a registered sale deed, conveyance deed, or allotment deed. Therefore, ownership does not become invalid or illegal merely because a Khata has not been issued or transferred.”
Do homebuyers in Bengaluru need Khata for applying for home loans?
According to Trivedi, most banks and housing finance companies in Bengaluru prefer a Khata as part of the documentation while processing home loan applications. It helps lenders confirm that the property is entered in BBMP records and is eligible for municipal taxation.However, Khata is not the sole determining factor for loan approval. Trivedi says that some lenders may still sanction loans based on the sale deed, approved plans, and other legal documents, especially in under-construction or newly completed projects where Khata transfer is pending.
Trivedi says: “If the builder does not transfer the Khata in the homebuyer’s name, it may result in delays, additional documentation requests, or stricter scrutiny by the lender, but it does not automatically invalidate the loan.”
