According to prosecutors, as reported by AFP, the alleged assault involving the second woman occurred on October 8, 2023, after an after-party at an apartment in Norway’s Lofoten Islands, where Høiby and his stepfather were staying during a surfing trip. The woman, whom Høiby reportedly met on Tinder, testified that after initially consensual sex, she later woke up to sexual activity that she said was not consensual.
"That's always been my worst nightmare," she told the court, as quoted by AFP. She recalled closing her eyes, saying she did so “so I wouldn’t have to take part in my own assault.”
"I remember waking up when he was already underway. I thought, 'I don't understand how someone can have sex with someone who's sleeping'," she said.
"Then, I mostly had the feeling I was dissociating, leaving my own body," she added.
"It was painful, my body wasn't ready for it."
According to AFP, the prosecutors told the Oslo court they submitted a video filmed by Høiby himself to support claims that the woman was unable to consent. The footage, later found on his phone by police, was played as evidence. Prosecutor Sturla Henriksbo said the five-second clip showed the woman asleep at the time of the alleged assault.
The woman testified that the video and images were recorded without her knowledge, an act for which Høiby is also charged. Prosecutors also presented data from her fitness watch, arguing it showed she was asleep, with changes in heart rate described as a key indicator.
Last week, the court heard testimony from another woman who alleged that Høiby raped her during an after-party in the basement of his parents’ estate outside Oslo in December 2018.
According to the BBC, the woman told the court she was '100 per cent' convinced she had been drugged during the gathering. She said she felt a deep sense of betrayal and shock after police showed her videos that allegedly depicted Høiby sexually assaulting her.
