A Karnataka court has passed a temporary injunction restraining wearables and electronic devices maker GoBoult, formerly known as Boult, from using the mark ‘GoBoult’ after DPAC Ventures LLP reached out to the court alleging that it is similar to its ‘GoBold’ brand.

DPAC Ventures LLP had approached the court claiming that Boult is using the ‘GoBoult’ mark, which is deceptively similar to its ‘GoBold’ brand that was registered much earlier. This, in turn, is creating confusion among users between the two brands, according to DPAC.

ET reached out to GoBoult but did not receive any response at the time of the publication of this story.

DPAC Ventures LLP owns the registration for the trademarks GoBold, GoJolt, and Govo from 2021, and these are valid until 2031, according to the court order seen by ET. Boult, founded in 2017, secured the registration for GoBoult in 2023 and started using the trademark.

After DPAC noticed that Boult is using a mark similar to their trademark, they reached out to the wearables brand to not use the trademark, but they refused. “(The) act of the defendant (GoBoult) made it clear that, knowingly that the plaintiff (DPAC Ventures LLP) is a registered trademarkholder, using a similar trademark(and) trade name which certainly would cause harm, loss to the business of the plaintiff,” the order stated.

DPAC further claimed that ‘GoBoult’ manipulated the search engines to show its products when users are looking for ‘GoBold’.

The court agreed with DPAC after seeing enough evidence for the claims and restrained Boult from “using, selling, offering for sale, soliciting, advertising, displaying or in any manner dealing in goods or services under the mark GoBoult or any other deceptively similar to the trademark "GoBold”.
