SC relief to banks in bilingual software installation case
State Bank of India moved Supreme Court challenging Rajasthan High Court's judgement, which asked them to install bilingual electronic software in all its branches spread across the country within six months.
Bilingual Electronic Software is applied in ATM services, accounting and processing, correspondence and general administration, apart from facilitating data entry in both Hindi and English at will.
A bench headed by Chief Justice K G Balakrishnan stayed the contempt proceedings filed against the banks by one Ajay Pandey (the petitioner) for not implementing the high court's directions.
Today, the apex court reiterated its previous observation made on an appeal by the Indian Banks Association, wherein it had allowed the banks to introduce the software "in cases where it is feasible".
SBI and its associate banks had also sought stay on the contempt proceedings before the high court, which had directed the banks and the financial institutions on April 9, 2007 and February 7 this year to introduce bilingual electronic software within six months.
Stating that the high court cannot pass directions in highly technical and specialised issues, the banks further said that the high court had exceeded jurisdiction by not only interfering with the administrative policy but also fixed a time limit for installation of the software in the banks.
Fixing of time limit of six months was totally arbitrary and ad hoc, and was not based on any material warranting such a fixation, Additional Solicitor General Mohan Parasaran and advocate A V Rangam stated.
