H-1B visa overhaul to take effect from January 17; what to know for FY26 lottery

The Department of Homeland Security’s long-awaited H-1B Modernization Final Rule, aimed at streamlining the hiring of highly skilled foreign workers while enhancing oversight, will be implemented on January 17. The changes address workforce demands, program efficiency, and regulatory clarity for employers navigating the visa process.

Employers petitioning for H-1B workers must use the updated Form I-129, which becomes mandatory on the same day the rule takes effect. To assist employers in adapting to the changes, a preview of the revised form is available on the US Citizenship and Immigration Services (USCIS) website.

Major updates to H-1B program

The H-1B program allows US employers to hire foreign professionals in specialized fields that require advanced qualifications. The final rule introduces several adjustments, including:

• Revised Specialty Occupation Criteria: Clarification of the link between the required degree and job duties.
• Expanded Flexibility: Nonprofit and governmental research entities exempt from the annual cap will benefit from updated eligibility terms.
• Support for F-1 Visa Holders: Transitioning F-1 students will experience fewer disruptions in lawful status and work authorization.
• Processing Efficiency: USCIS will expedite applications for previously approved H-1B visa holders.

Additionally, individuals with a controlling interest in their petitioning organization can now be eligible for H-1B visas, provided specific conditions are met.

To reinforce program integrity, the rule codifies USCIS’ authority to conduct inspections and impose penalties for violations. Enhanced scrutiny will ensure the program aligns with its original intent to address labor shortages in highly specialized sectors.

H-1B visa, 2026 season

The H-1B visa remains subject to an annual cap, with demand outstripping supply. USCIS will open cap registrations in March 2025 for fiscal year 2026 applications, continuing its lottery-based selection process.

“The changes made in today’s final rule will ensure that US employers can hire the highly skilled workers they need to grow and innovate while enhancing the integrity of the program,” USCIS Director Ur M. Jaddou emphasized the significance of the updates, said.

This overhaul reflects a step forward in addressing labor market challenges and ensuring a robust system for employers and skilled workers alike.
