Major updates to H-1B program
The H-1B program allows US employers to hire foreign professionals in specialized fields that require advanced qualifications. The final rule introduces several adjustments, including:- Revised Specialty Occupation Criteria: Clarification of the link between the required degree and job duties.
- Expanded Flexibility: Nonprofit and governmental research entities exempt from the annual cap will benefit from updated eligibility terms.
- Support for F-1 Visa Holders: Transitioning F-1 students will experience fewer disruptions in lawful status and work authorization.
- Processing Efficiency: USCIS will expedite applications for previously approved H-1B visa holders.
To reinforce program integrity, the rule codifies USCIS’ authority to conduct inspections and impose penalties for violations. Enhanced scrutiny will ensure the program aligns with its original intent to address labor shortages in highly specialized sectors.
