Is Spain really banning tourists?

Spain has introduced stringent measures to address overtourism, sparking debates worldwide. The so-called “Spain tourist ban” is not a complete prohibition on holiday rentals but rather a set of targeted restrictions designed to mitigate the impact of excessive tourism on local communities.

These measures come in response to increasing protests from residents in popular tourist destinations such as Mallorca, Barcelona, and the Canary Islands. According to reports, locals have voiced concerns about rising rents, housing shortages, environmental degradation, and the erosion of cultural identity caused by an influx of short-term holiday rentals and a surge in tourist numbers.

Starting January 14, 2025, Malaga will enforce a three-year ban on registering new short-term holiday rental properties in 43 districts where rentals account for more than 8% of residential buildings. Additionally, from February 22, 2025, existing tourist flats in Malaga that lack independent access separate from residential spaces will lose their licenses.


Malaga’s measures are part of a broader trend in Spain, with cities like Alicante and Madrid having implemented similar rules last year. Meanwhile, Barcelona has taken an even stricter approach, planning to phase out all tourist flat licenses by 2028 after having stopped issuing new ones since 2014. Seville and other cities are also expected to introduce comparable restrictions in the near future.

The primary goal of these regulations is to address key challenges associated with overtourism. Residents in tourist-heavy areas have struggled with skyrocketing rents and a lack of affordable housing due to the expansion of short-term rentals.

Additionally, the surge in visitors has strained local resources, contributing to environmental issues and overcrowding in public spaces. Authorities in Malaga and other cities hope these measures will not only make housing more affordable for residents but also help preserve the cultural identity of their communities.

Despite these restrictions, tourists can still find accommodation in Spain, including in Malaga. The city currently has 13,000 registered holiday rentals that will remain operational under the new rules. However, new registrations after February 22, 2025, will face strict scrutiny, with licenses revoked for properties that do not meet the specified requirements, such as independent access separate from residential portions of buildings.

As one of the world’s most popular travel destinations, Spain attracts millions of visitors each year. These new regulations represent a significant shift toward sustainable tourism, aiming to balance the economic benefits of tourism with the needs of local communities.
