Australia’s new arrival control law raises questions for students and workers returning home
New amendments grant the Minister for Home Affairs of Australia enforces visa-specific restrictions. Currently, these guidelines primarily affect individuals outside Australia who possess Visitor visas associated with Iranian passports. Indian stu...

The legislation excludes certain visa holders, including people holding specified humanitarian visas
Australia's new arrival control law raises this question, but they do not mean that every temporary visa holder is at risk of being stopped from returning. The distinction lies between the law, which gives the government the power to impose restrictions, and a specific government determination, which identifies the people affected.
For Indians planning to study, work or visit family in Australia, the important question is whether a specific government decision applies to their visa category and circumstances.
What is Australia's arrival control law?
The legal change was introduced through the Migration Amendment (2026 Measures No. 1) Act 2026. It amended Australia's Migration Act 1958 to give the Minister for Home Affairs the power to make an arrival control determination.

In simple terms, an arrival control determination is a temporary government order that can suspend the effect of temporary visas held by specified groups of people who are outside Australia. The law is intended to help the government respond to events or circumstances overseas that could increase the risk of certain visa holders remaining in Australia after their visas expire, or that might have affected the original decision to grant their visas.
The Minister must be satisfied that the circumstances meet the legal conditions and that making the determination is in the national interest. The Minister must also obtain written agreement from the Prime Minister and the Minister responsible for the Diplomatic Privileges and Immunities Act 1967.
Visa holders covered by the first determination
The first determination, announced on 25 March 2026, targeted a specific group: people outside Australia who held a Visitor (Subclass 600) visa linked to an Iranian passport. The restriction began in March 2026 and was set to run for six months.
This is an important distinction for Indian travellers. The first determination did not cover all visitors, students or temporary workers. Australia's government announcement explicitly said that people holding other visa types were not covered by that particular restriction.
The original determination was time-limited and was scheduled to end in September 2026. Travellers should check the current status of the determination and any subsequent instrument before relying on the original announcement as a statement of the rules in force today.
Could Indian students and temporary workers be affected in future?
The law gives the government the power to specify one or more classes of people in a determination. This means the first order's limited scope does not, by itself, establish that every future order must cover only visitor visas.

However, Indian students, temporary workers and business visitors are not automatically affected simply because they hold temporary visas. Whether they face a restriction depends on the exact terms of a determination in force, and whether they fall within the group it specifies.
For someone travelling to India between semesters or work assignments, the practical concern is whether a new determination applies while they are outside Australia. If it does, their visa could temporarily cease to be in effect, preventing them from using it to enter the country during the restriction.
Listing the exemptions
The legislation excludes certain visa holders, including people holding specified humanitarian visas, and provides exemptions for certain family members of Australian citizens and permanent residents. Parents of children under 18 who are in Australia are also covered by an exemption.
The Minister can issue a permitted travel certificate to allow an individual to travel despite a determination. However, the law does not require the Minister to consider every request, so this should not be treated as a guaranteed solution.
What should Indians check before travelling?
Indian students, professionals and visitors should check the Australian Department of Home Affairs website for the latest arrival control determination before making travel plans. They should confirm whether the order covers their visa subclass and circumstances, and whether any exemption applies. The key point is that a valid visa and permission to use that visa to enter Australia are not necessarily the same thing if an arrival control determination applies. But the law does not create a blanket restriction on Indian students or workers. The actual risk depends on the specific government order in force and the people it covers.
