Green-card interview pause casts a shadow over Indians' US plans

New Delhi: Spouses, minor children and ageing parents of Indian professionals working in the US, who have been waiting for final green card interviews, are among the worst affected by the Trump administration's pause on immigrant visa appointments, legal experts said.

"It's not a blanket cancellation of immigrant visa applications, but the pause in interview scheduling adds uncertainty, especially for those with current priority dates who expect to move forward soon," said Sukanya Raman, country head for India at immigration-focused law firm Davies & Associates.

While the pause is worldwide and non-discriminatory, it could disrupt relocation timelines, marriage plans, children's education and career plans for applicants, particularly those who had already completed documentation and were preparing for final interviews.

"Previous administrative actions were largely targeted by nationality or specific visa tiers, whereas this pause brings baseline consular immigrant processing to a standstill across every US post worldwide," said Ankita Singh, founder of law firm Sarvaank Associates.

For Indian professionals and families navigating multi-year permanent residency pathways, though, even temporary administrative halts create cascading scheduling delays and cross-border operational uncertainty, she said.

At any given time, thousands of Indian applicants are waiting for green card interviews. Current queries from applicants to immigration firms include, "How much longer?"

Experts are advising clients to not panic and evaluate options, including whether adjustment of status is possible.

The immediate consequence is procedural delay rather than automatic ineligibility, noted Rohit Jain, managing partner at Singhania & Co.

"But prolonged suspension could cause medical examinations, police certificates or supporting documents to expire, thereby increasing procedural hassle and costs," Jain said.

Experts are advising applicants to preserve all communications and monitor post-specific instructions.

They expect US consulates to cancel scheduled interviews of family-sponsored and employment-based applicants, or reschedule them without a declared restoration date.

Indian applicants already face substantial statutory queues in several preference visa categories, including EB-2 and EB-5.

From an enterprise perspective, this degree of unpredictability in visa processes for employment in the US naturally accelerates the broader trend toward workforce decentralisation and talent mobility, experts said.
