US EAD rule change explained and why an expired work permit could put your job at risk
Changes in the Employment Authorisation Documents (EAD) policy are set to affect foreign workers depending heavily on these documents. Renewal delays can lead to gaps in employment for many, particularly impacting H-4 spouses of H-1B visa holders....

Qualifying automatic extensions granted under the previous rules for renewal applications filed before October 30, 2025, are not cancelled by this rule.
The US Government has finalised a rule ending automatic extensions of Employment Authorisation Documents (EADs) for certain renewal applicants. Although the policy was introduced in October 2025, its finalisation brings renewed attention to what it means for foreign nationals who depend on these permits to remain employed while their applications are processed.

The key concern is the gap that could emerge between the expiry of an existing EAD and the approval of a renewal. Filing an application on time may no longer be enough to allow an affected worker to continue working during that period. So, what happens when an EAD expires, who could face problems, and what should workers do if their renewal is delayed?
Some foreign workers are authorised to work through their immigration status, while others need an EAD. Among those who may rely on one are eligible H-4 spouses of H-1B visa holders, certain applicants waiting for green cards and some asylum applicants.
For eligible H-4 spouses, an EAD can be particularly important because it allows them to work and earn their own income in the US. Without valid work authorisation, they may have to stop working, even if their spouse continues to hold a valid H-1B visa.
What has changed in the EAD renewal rules?
Earlier, eligible applicants who submitted their EAD renewal applications on time could receive an automatic extension of their work authorisation while USCIS processed their applications. Depending on the category and applicable requirements, this extension could last for up to 540 days. The US introduced a change ending these automatic extensions for affected renewal applications filed on or after October 30, 2025. The rule was finalised in October 2026.

Under the changed system, filing a renewal application does not, by itself, extend an affected applicant's permission to work beyond the expiry date of their existing authorisation. If the renewal is still pending when that date arrives, the person may have to stop working until the new authorisation is approved, unless another applicable provision allows them to continue.
This does not mean that all EAD holders lose their right to work when their cards expire. The rules depend on the person's immigration category and whether another provision applies.
What problems could an expired EAD create?
The most immediate concern is an interruption to employment. If a worker's authorisation expires before the renewal is approved, their employer may have to take them off work. The employee could face unpaid leave or a temporary suspension of duties, depending on the circumstances and the employer's policies.
The consequences may extend beyond the period away from work. An employee could miss deadlines, hand over projects or lose opportunities to take on new responsibilities. Employers may also have to rearrange work while waiting for the employee to receive valid authorisation.
There is a financial impact too. A worker who suddenly loses their salary may struggle to meet rent, loan repayments, insurance costs and other monthly expenses. If the delay continues, the uncertainty can make it difficult to plan future spending or make long-term commitments.
For families with two working spouses, the problem can be especially difficult. If an H-4 spouse depends on an EAD to work and has to stop earning, the household may have to manage on the H-1B spouse's income alone. The effect will depend on how long the interruption lasts and how much the family relies on that second salary.
Are there exceptions to the rule?
Yes. The change does not cancel every automatic extension already granted under the earlier rules. Qualifying extensions for renewal applications filed before October 30, 2025, are not cancelled by this rule. Certain extensions available under separate legal provisions, including some Temporary Protected Status arrangements, may also continue to apply.
An expired EAD also does not automatically mean that a person's immigration status has expired. Some people may have independent permission to work through their immigration status or another applicable provision. Workers must establish which rules apply to their own circumstances rather than assume that every EAD holder faces the same restrictions.
What should workers do if their renewal is pending?
EAD holders should check their permit's expiry date, renewal filing date and application status well before their current authorisation ends. If approval is delayed, they should speak to their employer's immigration team or a qualified immigration lawyer to determine whether they can continue working under any other applicable provision.
The most important point is that a pending renewal application is not necessarily permission to keep working. For affected applicants, a delay in receiving approval could mean a gap between jobs, a temporary loss of income and uncertainty about when they can return to work.
