UAE introduces stricter drug laws, mandates deportation for offenders

Under the revised law, pharmacies that dispense narcotic or psychotropic substances without a valid prescription will face a minimum prison term of five years and a fine of at least Dh50,000. Physicians who issue prescriptions for such substances without a licence will face the same penalties. Both violations are classified as acts of facilitating drug use.
Mandatory deportation for foreign offenders
Courts must order the deportation of non-citizens convicted of narcotics offences. Two exceptions apply: when the offender is a spouse or first-degree relative of a UAE citizen at the time of the offence, or when deportation would harm the stability of a family residing in the UAE or deprive a member of necessary care. In such cases, the family must also demonstrate financial ability to support treatment.The amendments allow private health facilities, along with federal and local authorities, to set up addiction treatment and rehabilitation units.
Changes to oversight and licensing
The federal decree reassigns responsibilities for regulating medical products and narcotics-related oversight. References to the Ministry of Health and Prevention are replaced with the Emirates Drug Establishment and its Chairperson, who now oversee medical product regulation. The Ministry of Interior’s role is replaced with the National Anti-Narcotics Authority, which leads national drug-control efforts.Updated rules also cover scientific and medical handling of narcotic and psychotropic substances. Qualified entities, such as health facilities, research centres, laboratories and medical product manufacturers, may obtain licences to possess or use such substances under supervision.
