The District Consumer Redressal Commission in Hyderabad has directed an international tour operator to refund over Rs 70,000 with 6% interest and additional compensation to a customer over a visa-related dispute. According to a TOI report, the ruling was in response to a complaint filed by a city-based bank employee who had booked a European tour package for his first wedding anniversary in August 2022.
The complainant had paid Rs 1,00,000 in advance, but his visa was rejected just days before departure. The court found that the rejection was due to the tour operator’s failure to provide necessary documents, such as hotel and flight booking confirmations, during the visa appointment. The visa refusal was attributed to the lack of justification for the purpose and conditions of the intended stay.
A three-member bench determined that the tour operator was guilty of deficient service and unfair trade practices. Initially, the operator admitted to negligence and agreed to a refund after minimal deductions. However, it later imposed a cancellation charge of Rs 45,000 per person and offered only Rs 10,000 as a refund.
The Commission rejected the operator’s argument that the complainant failed to justify his travel purpose. It ruled that the company had failed in its contractual obligations regarding visa processing. The final order mandated a refund of Rs 70,000 with 6% interest from September 29, 2022, along with Rs 30,000 as compensation for mental distress and financial loss, and Rs 10,000 towards legal expenses.
