Under the EB-5 Reform and Integrity Act of 2022, these thresholds are subject to inflation-linked adjustments every five years, beginning January 1, 2027. The adjustment is based on changes in the US Consumer Price Index for All Urban Consumers (CPI-U).
How much could the investment rise?
Industry estimates suggest the minimum investment for qualifying TEA and infrastructure projects could increase to between $900,000 and $937,500. For standard projects, the threshold could rise to between $1.2 million and $1.25 million. These are projections, not final figures. The revised amounts will depend on the statutory calculation and the official announcement by US authorities.

If these estimates prove accurate, investors choosing qualifying projects could need at least $100,000 more than the current minimum, while those investing in standard projects could face an increase of $150,000 or more.
Why the filing deadline matters
For investors hoping to qualify under the existing thresholds, the timing of their application is important. However, preparing an EB-5 petition involves more than transferring the investment amount.Applicants must demonstrate that their funds come from lawful sources and provide supporting documents, which may include tax records, bank statements, business income details and property-sale documents. Investors with financial assets across multiple countries may need additional time to collect and verify their records.
Starting the process early could help applicants avoid delays, but they should confirm the applicable filing rules with a qualified US immigration lawyer.
The EB-5 programme offers eligible foreign investors a route to permanent residency through qualifying investments that meet job-creation requirements. For Indian applicants, the potential increase means weighing the cost of investing now against the financial commitment required after the adjustment.
Investors should also assess project risks, legal fees, other charges and the conditions governing the return of their capital. The final investment thresholds should be confirmed through official US government announcements before any financial decision is made.
