What Centre's plea in Supreme Court is likely to say after Uttarakhand HC order

NEW DELHI: After the Uttarakhand HC order, the Centre has decided to rush an appeal to the SC saying it'd have been unconstitutional to allow the "minority" Harish Rawat government to continue after it "failed" to pass the budget.

The special leave petition, settled by attorney general Mukul Rohatgi, will be filed in SC on Friday, and will argue that the HC failed to appreciate that 35 of the 68 MLAs present in the assembly on March 18 had sought division on the appropriation bill.

The Centre will argue that though it was clear the Congress government had been reduced to minority , the Speaker, by declaring the money bill passed by voice vote committed an unconstitutionality .

The Centre will argue: The HC erred by misdirecting itself to examine sufficiency of the material for imposition of central rule when in the Bommai judgment, the SC had said that sufficiency of reason could never be a point of adjudication by constitutional courts to determine correctness of exercise of power under Article 356 to dismiss a state government.The Centre will cite the sting video featuring Rawat, who purportedly tried to lure MLAs with money and posts.

The nine rebel Congress MLAs, disqualified from voting in the April 29 floor test, will also challenge the HC decision, arguing that when their writ petition challenging the Speaker's decision was pending before a single judge HC bench, a division bench couldn't have debarred them from voting.
