We can't interfere with DMRC's decision to build stations: HC

The Delhi High Court on Thursday nudged a Kailash Colony resident over his plea to seek shifting of a proposed Metro station away from his property, saying the government could acquire anybody's land for public good.

NEW DELHI: The Delhi High Court on Thursday nudged a Kailash Colony resident over his plea to seek shifting of a proposed Metro station away from his property, saying the government could acquire anybody's land for public good.

"Do you say that your property cannot be acquired? If yes, then where is the difficulty?," said a bench of Justices T S Thakur and Aruna Suresh.

"We cannot sit over the small judgements of the Delhi Metro Rail Corporation such as its decision to build a station at a particular place," the bench said.

The court was hearing a petition filed by K N Chhibbar seeking a direction to the DMRC for shifting the site of a proposed Metro station in Kailash Colony.

The DMRC, which has filed an affidavit in the court, said the proposal, given to it by Chhibbar, for shifting the construction site by 100 meters was not feasible as it would create various problems including inconvenience to commuters.

The petition alleged that there was vacant government land nearby the proposed site and Chhibbar and others' properties have been acquired with malafide intention.

The Bench, then, deferred the hearing to February 14 after it was submitted that petitioner Chhibbar wanted to file a reply to the DMRC affidavit, dismissing the proposal to shift the construction site.

The Bench also adjourned the hearing on petitions of two RWAs from Greater Kailash, which are opposing Metro's elevated south Delhi corridor project on the ground that it would create noise pollution and intrude residents' privacy, to February 11.
