Tomar trouble: Ex-law minister wants case transferred from Delhi Police to some other agency

Tomar, who has been arrested on charges of forging his educational degrees, also raised questions on appointment of a special public prosecutor in the case by LG Najeeb Jung. He alleged the “so-called public prosecutor“ Taraunvir Singh Khehar was interfering with the investigation.
“Prosecution and investigation are two different jobs. The prosecutor is not supposed to be part of the probe but in this case the prosecutor is assisting police in documenting records of the case. I can prove the prosecutor's presence at the police station with CCTV footage and his call records,“ Tomar's counsel Rajiv Khosla said. Khosla also moved an application urging the court to “restrain the LGappointed prosecutor“ from entering the police station.
On Wednesday , Khehar had told the court that he was appointed as a special public prosecutor in the case by the LG. Usually , prosecutors are appointed by the Delhi government. The hearing wit nessed heated arguments between the defence and the prosecution. Khosla claimed that Khehar had no business to appear in the case alleging that he did not have the required documentation to appear as a prosecutor.
On the other hand, Khehar contended the had the LG's permission to do so. Khosla told the court the “special prosecutor“ should have a gazette notification to do so and police “cannot bring anyone as its counsel by flouting all rules“.“How can a private person file a vakalatnama on behalf of the DCP? The entire prosecution department has been thrown out to appoint him.Why so? I have no objection if he (Khehar) has a gazette notification,“ Khosla said.
