Yadav was elected to the Rajya Sabha in 2016 and his term was scheduled to end in July 2022. He was disqualified along with MP Ali Anwar, whose term expired in April. Both were disqualified under the anti-defection law on a complaint by another JDU Rajya Sabha MP Ramchandra Prasad Singh on the grounds that they had attended a rally of opposition parties in Patna in violation of party directives.
Yadav then appealed against his disqualification in the Delhi High Court on the grounds that he was denied a hearing before being disqualified. Consequently, the high court, in an interim order passed on December 15, 2017, refused to stay his disqualification but allowed him to draw his other entitlements as an MP. Ramchandra Prasad Singh then challenged the HC’s interim order in the top court.
