SC vacates stay on OBC quota in IIM-C
The apex court on Friday vacated a stay order by the Calcutta high court restraining the implementation of the 27% OBC quota law in IIM-Calcutta for the academic year 2008-2009.
The Centre had moved the Supreme Court on Thursday seeking suspension of the restraint order.
The Centre had told the court on Thursday that it had reliably learnt about concerted attempts by groups to flood high courts across the country with petitions seeking to stall implementation of the OBC quota cleared by the apex court.
The petition, drafted by advocate Subba Rao after news about the interim stay order reached Delhi on Wednesday, sought
transfer of the case pending before the Calcutta HC to the SC.
It also said that similar pleas pending before the Delhi HC and the Bombay HC should be transferred to the apex court for adjudication.
However, two judges ��� Justices Arijit Pasayat and C K Thakker ��� had felt that a graduate would be classified as an educationally advanced person.
This view was agreed to by Justice Dalveer Bhandari, who went a step further and directed that graduate OBCs should not be entitled to the benefit of reservation.
The Centre, in its transfer petition, said, "It reliably understands that concerted efforts are being made by various organisations to see that the provisions of Act 5 of 2007, which were upheld by the SC, are not implemented."
