SC unhappy over members of Executive taking up judicial roles
The Supreme Court on Monday took a strong note that members of the Executive were being appointed as heads of tribunals and adjudicating authorities for roles which were the domain of the judiciary.
"Executives are (being) appointed as Chairperson of adjudication authority. Step by step they are trying to exclude judiciary from tribunals and adjudicating authority," a Bench headed by Chief Justice K G Balakrishnan said.
The remarks came during the hearing of a PIL related to the constitution of a tribunal to deal with money laundering cases.
The apex court, which had stayed on December 3 last the notification related to the constitution of the tribunal, said a person appointed as Chairman of such bodies should have legal knowledge.
Additional Solicitor General Gopal Subramanium submitted that the appointment for the tribunal and appellate authority will be done after taking the Chief Justice into confidence.
However, the Bench, also comprising Justices R V Raveendran and L S Panta, asked the Centre to place its affidavit in this regard by February 21 and posted the matter for hearing on February 22.
