Justices A.K. Sikri and Arun Misra asked the special cell to submit a report in two weeks after Kapur’s lawyers Aman and Priya Hingorani told the court that he faced grave threat to his life.
The couple is in the midst of an ugly marital dispute involving custody of their two children - one boy and girl - and financial arrangements post-divorce.
The case is pending in a Bandra court in Mumbai since 2014.
Kapur now wants this case transferred from that court to a Gurgaon court. He has said that he fears for his life.
The couple initially filed a mutual consent divorce petition, but it ran into problems over custody and finance issues.
Sources said on the condition of anonymity that Sanjay got a threat over mobile after he had attended a hearing in Mumbai, warning him he would be eliminated if he ever entered the metropolis again.
His lawyers Aman and Priya Hingorani told the court that he faced a grave threat from alleged gangster Ravi Pujari and demanded transfer of the case.
They also informed the court that he had lodged a complaint to this effect with the Delhi police special cell. The top court then sought the report and adjourned the hearing.
