SC rejects PIL on SEZ agri land acquisition
The SC on Monday refused to entertain a PIL seeking direction restraining the government from acquiring agricultural land for the SEZs.
Advocate KC Ranjith appearing for a Kerala-based farmer submitted that land acquisition by governments was causing many socio-economic problems. Petitioner Donald Fernandez had said: ���The state has power to acquire any land irrespective of the nature of land. State can acquire agricultural land for public purpose by paying compensa-tion as equivalent to market value as provided under the act. Agricul-ture and farming is also for public purpose. When agricultural land acquires which directrly affects the fundamental rights of the farmer and agriculturist and the public at large".
According to petition, the right of the agriculturists comes under fundamental right to farm the land. So when, agricultural land is ac-quired, there is an infringment of their fundamental right.
The petition cited many examples of land acquisitions alleging their ill affects on farmers. The BMIC project in Karnataka shows that 21000 acres of agricultural land was acquired for express high way project. SEZ programme implemented in Nandigram in West Bengal and the resultant violence had shocked the nation, it said.
