Supreme Court refuses to stay BSP-Congress ‘merger’ in Rajasthan, leaves it to High Court

The Supreme Court refused to stay the ‘merger’ of six BSP MLAs with the ruling Congress in Rajasthan on the grounds that a no-confidence motion was not on the agenda of the assembly and instead left the issue to be decided by the high court.

New Delhi: The Supreme Court refused to stay the ‘merger’ of six BSP MLAs with the ruling Congress in Rajasthan on the grounds that a no-confidence motion was not on the agenda of the assembly and instead left the issue to be decided by the high court.

The high court will deal with the matter on Friday while the top court will hear the issue again on Monday. The opposition BJP in the state had sought a stay on an earlier order of the Speaker refusing to disqualify the BSP MLAs in the state who had merged en masse with the ruling Congress headed by CM Ashok Gehlot on the grounds that it was a ‘merger’.

A bench led by Justice Arun Mishra, which was dealing with a plea by the BJP against the merger, refused to pass any immediate orders on Thursday, saying a no-confidence motion did not figure in the House agenda when it reconvenes on August 14.
