SC okay with PILs, seeks norms to stop misuse

The Supreme Court on Wednesday justified judicial intervention to protect the rights of the people in case of the inertia of the executive.

NEW DELHI: The Supreme Court on Wednesday justified judicial intervention to protect the rights of the people in case of the inertia of the executive. The apex court, however, sought guidelines for entertaining PILs to shortcircuit the possible abuse of judicial process through camouflaged petitions.

���Who will protect the rights of the common man if the executive does not do its duty,��� asked a bench comprising Chief Justice K G Balakrishnan, Justice R V Raveendran and Justice M K Sharma.

���When authorities are not taking action, who will take the action. Do you expect that a common man who is denied admission in a hospital will go to a chief minister with a complaint,��� the court said while hearing two PILs.
The bench came down heavily on hospitals and corporate houses which, after securing land at concessional rates for welfare purposes, cheat people by not adhering to their mandate.

���Nobody is prepared to protect the common man���s right. Who will protect the rights of the common man if the executive does not do its duty,��� the court said.
