SC Collegium agrees to reiterate Justice K M Joseph's name for elevation to top court
An earlier collegium recommendation made within days of a judgement by Justice Joseph quashing president's rule in uttarakhand is also still pending with the government.
Should and when the court sends back the recommendation it will be binding on the government. The law ministry had while clearing the elevation of justice Indu Malhotra held back Justice Joseph's name.
An earlier Collegium recommendation made within days of a judgement by Justice Joseph quashing president's rule in Uttarakhand is also still pending with the government.
The Collegium has agreed to send back it's recommendation for elevation to the top court, sources confirmed. However, it may not be sent right away.
The Collegium is also debating other names for elevation to the top court on the lines suggested by the government -- give representation to unrepresented states such as Rajasthan and Uttarakhand and Andhra and Telangana and weaker sections.
Once these names are finalised, they may be all sent together back to the law ministry. The unintended consequence -- Justice Joseph's tenure at the top court will be shorter.
