SC asks states to make marriage registration must
The Supreme Court on Thursday asked all the states and Union Territories to make registration of marriages compulsory for all religions within three months.
The apex court took an exception to the fact that some of the states have made laws for the compulsory registration of marriages to the hindus only but did nothing for other religions. However, it had ordered for the mandatory registration of marriages for every citizens of the country irrespective of their religious persuasions, court noted.
A bench comprising Justice Arijit Pasayat and Justice P Sathasivam said: “We therefore, direct that the states and Union Territories who have not acted in line with the directions given on 14.2.2006 shall forthwith do it and in no case later than three months from today”. The apex court had directed for compulsory registration of all marriages in the country.
The court said that in five states provisions appear to have been made for voluntary registration of muslim marriages. These are Assam, Bihar, West Bengal, Orissa and Meghalaya.
SQR Ilyas, member of the working committee of All Indai Muslim Personal Law Board (AIMPLB) talking to ET said: “The registration of Muslim marriages should be left optional. It should not be imposed against the will of the Muslims.
In case, it is enforced upon the Muslim community, it may infringes upon the Sharait Law which will cause problems”.
