Sanjay Dutt to spend Diwali in jail
Actor-convict Sanjay Dutt will not be able to spend Diwali with his family members as the apex court on Friday announced that it would take up his regular bail plea on November 20.
Friday was the last working day for the Supreme Court before Diwali.
The actor was, in July 2007, sentenced to six years' rigorous imprisonment, for illegal possession of an AK-56 rifle prior to the March 12, 1993 bomb blasts, even though the judge held that he was no terrorist and not concerned with the conspiracy behind the blasts.
Importantly, out of the 100 accused that faced trial in the case, he was among the four to be exonerated of all charges under Tada.
Dutt's lawyers had worked overtime to move the bail petition keeping in mind the actor's desire to spend Diwali at home.
It had a short prayer, "Suspend the sentence of the appellant (Dutt) pending final hearing of the appeal against the conviction judgment passed by the designated court and release him on bail."
The petition, filed through counsel Hari Shankar K, had presented the argument that Dutt had undergone the agony of a trial for more than 14 years and cited an apex court judgment that had held that "agony of protracted trial itself constitutes a sentence".
The known facts - that he had been on bail for over 12 years, never violated a single bail condition and that he had already undergone incarceration of 17 months - were pleaded in the petition.
