Refer Ayodhya case to larger bench: Muslim bodies to SC

He urged the court to refer the issue of legality of a finding by an earlier bench that a mosqueis not essential to the practice of Islam to a larger bench.

The Muslim parties contesting the verdict in the Ram Janmabhoomi-Babri Masjid case argued in the Supreme Court on Tuesday that the high court judgement which carved up the land three ways between the Hindus and Muslims was based on a wrong premise.

“The judgement proceeds on the assumption that the Muslims do not have a constitutional right to pray at the Babri Masjid. The Muslims have no rights, but the Hindus have a superior right,” lead counsel Rajeev Dhavan said.

He urged the court to refer the issue of legality of a finding by an earlier bench that a mosqueis not essential to the practice of Islam to a larger bench.
