MUMBAI: In a relief for apparel brand Provogue's owner Salil Chaturvedi, the Bombay High Court on Monday upheld the lower court's order that he will be chargesheeted separately, not with co-accused, in cocaine seizure case.

As a result, Chaturvedi will be tried only for possessing 3 gm of cocaine. Police's case was that he was part of a cartel that dealt in drugs, which would have attracted much higher penalty in the event of conviction.

On August 3, 2005, Chaturvedi was arrested on the charges of possessing cocaine at his residence. Prior to that, on January 26, 2005, police had detained provogue employee Allwyn Sequeira at Mumbai airport. He told the police that drug was handed to him by Vishal Manghanani, another Provogue employee, for taking to Chennai.

Manghnani was arrested in June 2005. In July, assistant police inspectors Suresh Shinde and Shantilal Jadhav were arrested for alleged tampering with evidence in return for a bribe from Meghnani.

After Chaturvedi's arrest in August 2005, three Tanazanian nationals too were picked up in connection with same case.

But special Narcotics and Psychotropic Substance Act court held last year that trial be separated into three cases: one involving Sequeira, Manghnani, Shinde and Jadhav. Second related to three Tanzanians, and third one involving Chaturvedi.

The state government had challenged this order, but Justice D G Karnik today upheld the lower court order.
