The Supreme Court on Tuesday stayed trial court proceedings against former Chief Minister BS Yediyurappa in a case of sexual assault of a child under the under the Protection of Children from Sexual Offences Act (Pocso Act), 2012.

A bench consisting of Chief Justice Surya Kant and Justice Joymalya Bagchi granted relief on a special leave petition (SLP) filed by Yediyurappa against a Karnataka high court order refusing to quash the case registered against him.

The apex court ordered notices to the CID and the private respondent to examine if the matter should be remanded back to the high court to take a fresh look based on merit. A senior advocate appearing for Yediyurappa said the case was born out of political vendetta against the 82-year-old leader who was a CM four times before.


The Pocso case arises from an FIR that the Bengaluru Police registered against the BJP leader in March last year based on a complaint from a woman who accused him of sexually assaulting her 17-year-old daughter. The government, later, transferred the case to CID.
