Notice to CBI chief in Salem case
A Delhi court issued notice to the director of the Central Bureau of Investigation (CBI) on Saturday.
���Issue notice to the CBI director for August 6 for apprising the court about extradition of Abu Salem,������ additional sessions judge Ravinder Kaur said.
The order came after additional solicitor general Vikas Singh submitted that it was actually a case of deportation as the accused was caught in Portugal for using forged travel documents.
The ASG, who had, on behalf of the Delhi police sought the dropping of charges under the Maharashtra Control of Organized Crime Act (MCOCA) against Salem, had responded to a court query as to why the Centre had gone in for his extradition instead of deportation , putting restrictions on the number of cases in which he could be tried and on the quantum of sentence.
The NDA had given an assurance that after Salem���s extradition, he would not be tried for offences which may invite imprisonment exceeding 25 years. Salem is facing MCOCA charges in connection with an extortion call made to city-based businessman Ashok Gupta in 2002, demanding Rs 5 crore as protection money .
He was extradited from Portugal in 2005 in cases such as the Mumbai blasts, passport cases in Lucknow and Hyderabad , three extortion cases and a conspiracy to murder case in Delhi, and the Pradip Jain and Ajit Dewani murders in Mumbai. The court has asked the Arthur Road jail authorities, where Salem is currently lodged, to ensure his presence in court on August 6.
