Non compliance of sealing orders, SC summons police chief



New Delhi: Angered over a complaint that police and the MCD were acting in collusion to avoid sealing of unauthorised commercial constructions in the capital, the Supreme Court today directed the Delhi Police Commissioner K K Paul and other police officers to personally appear before it tommorow.

A three-member bench of justices- Arijit Pasayat, C K Thakkar and L S Panta- while directing the police chief and his subordinates to personally appear with affidavits and their explanations; also directed the MCD commissioner to file his affidavit to explain why no sealing operation was being carried out in the capital.

The apex court further ordered that all unauthorised constructions which do not conform to the 2021 Master Plan for Delhi (MPD) should be sealed by the MCD and sought the Union Government's reply to explain the time frame by which it would create adequate infrastructure facilities like water, parking and sanitation to meet the requirements of the plan.

The bench summoned the police chief and others after taking a serious view of the submission made by amicus curaie (court officer) Ranjit Kumar's complaint that no sealing operation was being carried out in the city on account of the "collusion" between the MCD and the police machinery.

Justice Arijit Pasayat, who spoke for the Bench, rejected the repeated pleadings of the Delhi police counsel Ashok Bhan that the Police Commissioner cannot be summoned as he cannot be held liable for the reported non-compliance of the court's order.(
