No third floor in commercial areas, SC tells MCD

The SC said that construction of a third floor would be permissible only in residential localities and not in commercial areas of the national capital.

NEW DELHI: The Supreme Court on Monday said that construction of a third floor would be permissible only in residential localities and not in commercial areas of the national capital.

A Bench of Justices Arijit Pasayat and P Sathasivam clarified that its earlier order permitting construction of third floor was restricted only to residential users.

The Apex Court clarified the order after MCD counsel Sanjiv Sen moved an application before the bench seeking to know whether such constructions were permissible in commercial areas.

The counsel claimed that such a clarification was essential as the MCD officials were confused about the applicability of the Bench's earlier direction.

"There is no need for clarification. Your officials deal on case-to-case basis and suitcase-to-suitcase basis," the Bench remark sarcastically, disposing off the MCD application.
