No secret deal between CM Buddhadeb Bhattacharjee and industrialist Ratan Tata over Singur land.
Advocate General Balai Roy, appearing before a division bench comprising Chief Justice S S Nijjar and Justice P C Ghose, referred to the petitioner's allegation that the Chief Minister had connived with Ratan Tata to make a gift of the land to the Tatas. He described the allegation as baseless.
He claimed no fact in support of the allegation was disclosed by the petitioners who had filed PILs challenging the acquisition of 997 acre at Singur.
Consequently, the allegation of malafide against the Chief Minister was totally unfounded, Roy submitted.
The Supreme Court has pointed out that the decision on acquisition of land for public purpose was primarily a matter of exclusive policy decision of the state government, he said.
The court ordinarily would not go behind the declaration under section VI of Land Acquisition Act, 1894, unless malafides or colourable exercise of power was proved, the advocate general said.
It was submitted by quoting from the averment of each of the writ petitioners that no specific fact has been stated in any of the petitions to assist the court to come to a conclusion whether there was malafide or colourable exercise of power.
