Sameer's father Dnyandev Wankhede had filed a defamation suit against Malik, seeking Rs 1.25 crore in damages, for Malik's allegations. Wankhede had asked the court to restrain Malik from making more 'defamatory allegations' against him or his family.
Malik has claimed that Wankhede senior had converted to Islam to marry a Muslim and their children, including Sameer, were raised as Muslims, but Sameer 'reverted to his father's Mahar community', a Scheduled Caste, to get into the civil services, Malik had alleged.
To support his allegations, he had produced Wankhede's birth certificate, where his father's name was written as Dawood Wankhede and religion as Muslim. The Wankhede family had said the birth certificate was not authentic, but Malik's counsel advanced the arguments in the HC by asking the family to furnish Sameer Wankhede's original birth certificate.
