NALCO's school staff story goes to SC
Aluminium PSU NALCO has moved the Supreme Court, challenging an Orissa High Court order that asked it to absorb more than 6,500 staffers of schools set-up by it and provide them with similar benefits enjoyed by other PSU employees.
NEW DELHI: Aluminium PSU NALCO has moved the Supreme Court, challenging an Orissa High Court order that asked it to absorb more than 6,500 staffers of schools set-up by it and provide them with similar benefits enjoyed by other PSU employees.
A bench comprising Justice H K Sema and Justice L S Panta deferred the hearing, asking the employees to file a rejoinder.
Solicitor General G E Vahanwati said that the High Court directions will have a wider repercussions, forcing all public sector organisations like NTPC, Mahanadi Coalfileds, etc to take over the teaching and non-teaching staff of all the schools set up by them.
While stating that it only extended financial assistance, NALCO stated that the school employees were never recruited by it and were appointed and managed by Chinmaya Vidyalaya in the beginning and later by Shikshya Vikah Samiti under the Saraswati Vidya Mandir Employees Recruitment and Conditions of Service Rules.
"The government is also providing grant-in-aid to various schools and colleges and also controls the creation and functioning of the governing body but that does not mean that these aided schools and colleges become government schools and colleges," Vahanvati said.
Senior Counsels K K Venugopal and Mukul Rohtagi, appearing for the employees, stated that the employees should be absorbed by the PSU as their appointments were made by NALCO.
