Maya gets reprieve in Taj case

The Supreme Court has refused to set aside the order of UP Governor TV Rajeshwar not according sanction to prosecute Chief Minister Mayawati in the Rs 175-crore Taj Heritage Corridor Project case.

NEW DELHI: The Supreme Court on Wednesday refused to set aside the order of UP Governor TV Rajeshwar not according sanction to prosecute Chief Minister Mayawati in the Rs 175-crore Taj Heritage Corridor Project case. The apex court said the "special judge concerned is looking into the matter".

It said the order of the magistrate will be a subject matter of appeal. The court said if the investigating agency CBI decides not to question such order, independent public interest litigation can be filed in the court.

A special bench comprising Justice SB Sinha, Justice SH Kapadia and Justice DK Jain said, "Once a final report has been filed in terms of sub-section (1) of the Code of Criminal Procedure, it is the magistrate and magistrate alone who can take appropriate decision in the matter one way or the other."
