In the letter, Kejriwal said: “I wish to bring to your kind notice two specific issues adjudged by Hon’ble Supreme Court — LG’s ‘concurrence’ would now not be required on any matter and executive powers related to ‘services’ lie with the Council of Ministers.”
Hours after the ruling, deputy CM Manish Sisodia had ordered that no transfer or appointment could be carried out without the permission of the CM, deputy CM or other cabinet ministers. The services department, however, sent a note saying the SC has not yet cancelled a Union home ministry notification of May 2015 that had assigned the job of transferring and posting bureaucrats to LG.
Meanwhile, Sisodia issued fresh orders to the department to comply with the orders or face contempt of the court. Earlier in the day, he said AAP was exploring legal options as the rejection of the orders by bureaucrats was “legally incorrect”.
