JDS mulling to move HC praying for interim order

BANGALORE: Opposition JDS today said it was mulling to move the Karnataka High Court praying for an interim order on the petition challenging disqualification of 16 MLAs, over which the court has reserved its order in view of tomorrow's trust vote.

The party is seeking legal opinion whether an application can be filed by disqualified MLAs seeking stay on their ouster and facilitate them to participate in the voting during the motion of confidence, JDS spokesman Y S V Datta told PTI here.

However, he hastened to add that the issue is still under discussion and a final decision on approaching the court will be taken shortly.

The special bench of the High Court had yesterday declined to pass an interim order on the petition filed by the MLAs, including 11 of BJP, seeking to quash the orders of the Speaker, terming their disqualification as a "clear violation of statutory rules".

The court adjourned till October 18 hearing in the case.

Speaker K G Bopaiah had disqualified 11 BJP MLAs and five independents just ahead of the trust vote in the Assembly on October 11, which was won by Chief Minister B S Yeddyurappa.
